Terms of use

1. Purpose

These terms of use govern access to the homr-studio.com website and the app.homr-studio.com application (together, “Homr”), published by Brendan Viale, sole trader (entrepreneur individuel, EI), SIREN 808 716 450. The publisher's full contact details are in the legal notice.

Paid subscriptions and marketplace purchases are also governed by the terms of sale.

2. Acceptance

By creating an account or using Homr, you accept these terms of use. If you do not accept them, do not use Homr.

3. The service

Homr helps turn an idea into a real project. In particular, it lets you:

• build a project from an atlas, a path of steps, and work on it on whiteboards, alone or with others;
• get help from Ulyss, Homr's artificial intelligence;
• create or follow courses;
• publish, import and buy atlases and courses on the marketplace.

Using Homr is free. Publishing and selling on the marketplace requires a paid subscription. Homr's features evolve: some may be added, changed or removed.

4. Your account

• Age. Homr is reserved for people aged 15 or over. Subscribing, buying or selling on the marketplace is reserved for adults.
• Accuracy. The information you provide when signing up must be accurate and kept up to date.
• Security. You are responsible for keeping your credentials confidential and for any action taken from your account. Report any unauthorised use without delay to contact@homr-studio.com.
• Collaboration. When you invite someone to a project, you choose their role (editor or reader) and they get access to that project's content. You remain responsible for the access you grant.

5. Rules of use

When using Homr, you agree not to:

• publish content that is unlawful, defamatory, abusive, hateful, violent or pornographic, or that infringes the privacy or rights of others, including copyright and trademark rights;
• impersonate another person;
• send unsolicited messages or promote services without permission;
• disrupt Homr's operation, bypass its technical limits or try to access data not intended for you;
• systematically extract Homr's content, including with bots, in breach of Articles L. 342-1 et seq. of the French Intellectual Property Code;
• use Ulyss to produce unlawful or misleading content;
• resell or provide access to Homr to a third party without permission.

6. Your content

The content you create on Homr remains yours. You warrant that you hold the necessary rights to what you publish there.

To run the service, you grant Homr a non-exclusive, free, worldwide licence to host, reproduce, display and transmit your content. It lasts only as long as the content is on Homr and is limited to what the service requires: showing it to the members of your projects and, for what you publish on the marketplace, to the users who view, import or buy it.

An atlas imported by another user is copied into their project and stays there, even if you later unpublish or delete it. A course remains accessible to people already enrolled, even if you withdraw it.

Homr may remove content that breaches these terms or the law, in particular after a report.

7. Artificial intelligence

Ulyss's answers are generated automatically and may be inaccurate or incomplete. They are not professional advice, including legal, accounting, tax or financial advice. Check them before using them: you remain responsible for how you use them.

8. Content published by other users

The atlases and courses on the marketplace are created by Homr users, who are solely responsible for them. Homr does not check their accuracy. In particular, a course about investing or trading is not investment advice: your financial decisions remain your own.

To report content you consider unlawful, email contact@homr-studio.com with the page address, the content concerned and the reason for your report.

9. Homr's intellectual property

Homr's software, name, logos, texts and design are protected by intellectual property law. Homr grants you a personal, non-exclusive and non-transferable right to use the service in accordance with these terms. You may not copy, modify or decompile it, or create a derivative work from it.

10. Availability

Homr strives to keep the service available at all times but cannot guarantee it. It may be interrupted for maintenance, updates or in the event of an incident. Keep a copy of your important content.

11. Liability

Homr is bound by an obligation of means. Within the limits permitted by law, it cannot be held liable for indirect damage, for content published by users, or for how you use content generated by Ulyss. Nothing in these terms limits the rights the law grants to consumers.

12. Account suspension and deletion

• At your request. You can ask for your account to be deleted at any time by emailing contact@homr-studio.com from the account's email address. Your content is then erased, except data the law requires us to keep and copies or enrolments already acquired by other users on the marketplace.
• At Homr's initiative. In the event of a serious breach of these terms, Homr may suspend or delete your account after asking you to remedy the situation, except in an emergency (manifestly unlawful content, threat to the security of the service).
• Inactivity. An account inactive for 3 years is deleted.

13. Personal data

How Homr processes your data is described in the privacy policy.

14. Changes to these terms

Homr may change these terms. If there is a significant change, you will be informed in the application or by email before it takes effect. Continuing to use Homr after that date means you accept the new terms.

15. Governing law and disputes

These terms are governed by French law. In the event of a dispute, first email us at contact@homr-studio.com to seek an amicable solution. Failing that, the courts of Marseille have jurisdiction, subject to the rules that allow consumers to bring proceedings before the court of their place of residence.
