Terms of sale

1. Purpose
These terms of sale apply to:
- the paid Homr Hobby and Homr Pro subscriptions;
- sales of atlases and courses concluded on the Homr marketplace between the users who sell them (“sellers”) and those who buy them (“buyers”).
They supplement the terms of use. Every order requires their acceptance, given by ticking the box provided before payment. The applicable version is the one in force on the date of the order.
2. Provider
Subscriptions are sold by Brendan Viale, sole trader (entrepreneur individuel, EI), ESF Isola 2000, 06420 Isola, France, SIREN 808 716 450, EU VAT number FR09808716450 (“Homr”). For any question about an order or a complaint: contact@homr-studio.com.
3. Plans and prices
- No subscription. Free: create atlases and courses for your own use, invite collaborators, import and buy what others publish.
- Homr Hobby. €24.99 excl. VAT per month, or €239.88 excl. VAT per year (€19.99 per month). Commission on each sale: 10% + €0.30.
- Homr Pro. €120 excl. VAT per month, or €1,188 excl. VAT per year (€99 per month). Commission on each sale: 2.9% + €0.30 for a sale under €900, 3.9% + €0.30 from €900.
Hobby and Pro give the same rights: publishing atlases and courses on the marketplace and selling them. Only the subscription price and the commission differ.
Prices are shown in euros, excluding tax. VAT due for your billing country is added, and the total including tax is shown before you confirm payment.
Homr may change its prices. A new price only applies from the next renewal, after being announced to you at least 30 days in advance; you can cancel before it takes effect.
4. Ordering and payment
To subscribe, choose a plan and a billing period, enter your billing country, check the summary, accept these terms of sale and confirm payment. The contract is concluded when the payment is confirmed.
Payments are processed by Stripe. You can pay by card or with Link. Your card details are entered with Stripe: Homr never has access to them. An invoice is issued for each payment and remains available from the billing area, on the “My subscription” page.
5. Term, renewal and cancellation
- Renewal. The subscription is taken out for one month or one year. It renews automatically for the same term, and each period is paid at its start.
- Renewal reminder. If you are a consumer on an annual subscription, Homr informs you by email, between one and three months before the renewal date, that you may choose not to renew.
- Cancellation. You can cancel at any time from the “My subscription” page in a few clicks. Cancellation takes effect at the end of the current period, which has already been paid and is not refunded, except if you exercise the right of withdrawal.
- Changing plan. You can switch plan or billing period from the billing area. The amount is adjusted pro rata to the time remaining.
6. Failed payment
If a renewal cannot be charged, Stripe retries the payment and the “My subscription” page tells you how to settle it. Until the subscription is paid, your published content is removed from the marketplace and you can no longer publish; it comes back as soon as payment is settled. Buyers keep access to what they have already acquired.
7. Right of withdrawal (subscriptions)
If you are a consumer, you have 14 days from subscribing to withdraw, without giving any reason. To do so, send us an unambiguous statement at contact@homr-studio.com, for example using the model form in the appendix.
By ticking the box provided before payment, you ask for your subscription to start immediately, without waiting for this period to end. If you then withdraw, Homr refunds you within 14 days the amount paid, minus the share corresponding to the period already elapsed, using the payment method used for the order.
Businesses do not have this right.
8. Marketplace
Homr's role. Homr connects sellers and buyers. The sale of an atlas or a course is concluded directly between them: Homr is not a party to the sales contract. Payment is collected by Stripe on the seller's behalf, and Homr receives a commission deducted from the sale amount.
Ranking. Marketplace content is ranked by number of uses. No seller can pay for a better ranking.
Seller status. A seller may be a business or an individual. When the seller is not acting in a professional capacity, consumer protection law does not apply to the sale.
8.1 For buyers
- Price. The price is set by the seller and shown on the content's page before purchase.
- Access. A purchased course is opened to you as soon as payment is confirmed and stays open, even if the seller later withdraws it. A purchased atlas can be imported into your projects; an imported atlas stays there, even if the seller unpublishes it.
- No right of withdrawal. An atlas or a course is digital content supplied as soon as payment is confirmed. By ticking the box provided before payment, you request this immediate access and expressly waive your right of withdrawal (Article L. 221-28, 13°, of the French Consumer Code).
- Complaints. Any complaint about purchased content can be sent to contact@homr-studio.com. Homr forwards it to the seller, who is solely responsible for the content. A payment made twice for the same content is refunded automatically.
8.2 For sellers
- Requirements. Selling requires an active Hobby or Pro subscription and a verified Stripe payment account. Stripe verifies your identity and bank details.
- Stripe. Payment services are provided by Stripe. By opening your payment account, you accept the Stripe Connected Account Agreement, which includes the Stripe Services Agreement.
- Price and commission. You set the price of your content freely: free, or at least €1. The commission of your plan at the time of the sale is deducted automatically; Stripe pays you the rest on its payout schedule.
- Responsibilities. You are the seller of your content. You warrant that you hold the rights to it and that it is lawful and matches its description. You are responsible for your tax and social obligations and, if you are a business, for your information and invoicing obligations towards your buyers. Payment disputes and their fees are borne by you.
- End of subscription. If your subscription ends or remains unpaid, your published content is removed from the marketplace and can no longer be bought. Buyers keep access to what they have already acquired.
- Removal. Homr may remove from the marketplace content that breaches the terms of use or the law.
9. Liability
Homr is bound by an obligation of means as to the availability of the service. It cannot be held liable for indirect damage or for the content of atlases and courses sold by users. Towards a business, Homr's liability is limited to the amounts paid for the subscription over the last 12 months. Nothing in these terms of sale limits the rights the law grants to consumers.

11. Governing law and disputes
These terms of sale are governed by French law. In the event of a dispute, and failing an amicable settlement, the courts of Marseille have jurisdiction, subject to the rules that allow consumers to bring proceedings before the court of their place of residence.
Appendix: withdrawal form
